Rancho Colorados

By registering my child(ren) for a Rancho Colorado Swim Team program, I agree to the following refund and cancellation policies as they pertain to each program:

2025 SWIM TEAM

For non-high school swimmers, the last day for refunds, minus a $50 processing fee per swimmer, is Sunday, April 20, 2025. For high school swimmers, the last day for refunds, minus a $20 processing fee per swimmer, is Sunday, April 20, 2025. 

Note: In the event of unexpected or unforeseen, extended periods of pool closure, the swim team committee will evaluate refunds and make up sessions at that time.

I, member of the Rancho Colorados Swim and Tennis Club, hereby grant Rancho Colorados Swim Team (“Swim Team”) and their agents the absolute right and permission to use photographic portraits, pictures, digital images, or videos of me, or in which I may be included in whole or part, or reproductions thereof in color or otherwise for any lawful purpose whatsoever, including but not limited to use in any Swim Team websites, social media accounts, as well as Diablo Community Swim League (DCSL) website(s) and social media accounts, without payment or any other consideration.

I hereby waive any right that I may have to review, inspect and/or approve the finished product or the copy that may be used in connection therewith, wherein my likeness appears, or the use to which it may be applied in any promotional, media, or social media medium in connection with any Swim Team website(s), social media accounts, as well as DCSL websites and social media accounts.

I hereby release, discharge, and agree to indemnify and hold harmless the Swim Team, DCSL, and their agents from all claims, demands, and causes of action that I have or may have by reason of this authorization or use of my likeness in photographic portraits, pictures, digital images, or videos, including any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of said images or videos, or in processing tending towards the completion of the finished product, including publication on the internet, in brochures, or any other advertisements or promotional materials.

I represent that I am at least eighteen (18) years of age and am fully competent to electronically agree to accept and sign this Release. 

I, the parent/guardian of the registered participant(s) (“My Child” or "My Children"), grant Rancho Colorados Swim Team (“Swim Team”) and their agents the absolute right and permission to use photographic portraits, pictures, digital images, or videos of My Child/Children, or in which My Child/Children may be included in whole or part, or reproductions thereof in color or otherwise for any lawful purpose whatsoever, including but not limited to use in any Swim Team websites, social media accounts, as well as Diablo Community Swim League (DCSL) websites and social media accounts without payment or any other consideration.

By registering for the Rancho Colorados Swim Team (“Swim Team”) I, the undersigned parent/guardian, request voluntary participation for a minor/minors to participate in all activities and events (“Activities”) offered by the Swim Team. In consideration of being allowed to participate in any Swim Team Activities, I expressly acknowledge and agree to the following:

1. I understand and accept that as part of the Swim Team, swimmers may be exposed to extreme conditions and circumstances; hazardous natural or manmade objects; and dangers arising from adverse weather conditions, water hazards, inadequate safety measures, situations beyond the immediate control of the Swim Team or the Rancho Colorados Swim and Tennis Club (“the Club”), as well as other undefined harm or damage which may not be readily foreseeable, and other presently unknown risks and dangers. I understand that participation in the Activities is voluntary, involves risks and dangers which include, without limitation, the potential for serious bodily injury, illness, permanent disability, paralysis, and death. I understand that these risks may be caused in whole or in part by my own actions or inactions, the actions or inactions of others participating in the Activities, or the acts, inaction or negligence of the Released Parties, as defined in this Release. I also understand that if I have any risk concerns, I should discuss the risks associated with my participation with the activity coordinators and event staff before I sign this document and before any activities begin.
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERS, AND ASSUME FULL RESPONSIBILITY FOR THE PARTICIPATION OF MYSELF, MY CHILD(REN), WARDS, OR OTHER FAMILY MEMBERS.
3. In consideration of allowing the above-referenced minor(s) to participate in the Activities, I hereby release and hold harmless the Club, the Swim Team, their administrators, board members, officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, volunteers, and, if applicable, owners and lessors of premises used for the Swim Team activities, (collectively, the “Released Parties”), and do hereby discharge and waive, any and all claims, demands, losses, damages, and liabilities that I may have or sustain with respect to any and all damage and/or injury, of any type, arising from the registered minor’s participation in the Swim Team activities.
4. I further agree to indemnify and hold harmless the Released Parties from any and all claims, demands, losses, damages and liabilities for indemnities, contribution or otherwise with respect to any damage and/or injury, of any type, arising from the above-referenced minor’s/minors’ participation in the Activities. I also agree that this Liability Release and Indemnity Agreement extends to all acts of negligence by the Released Parties, and is intended to be as broad and inclusive as is permitted by California law. I agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL LEGAL RIGHTS BY AGREEING AND ACCEPTING IT, FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

A parent/guardian of minor child/children registering for the Rancho Colorados Swim Team, I have read and accepted the following agreements, policies, and waivers, and agree to abide by the contents thereof:

• Medical Release Waiver
• Refund and Cancellation Policy
• Adult Media Consent
• Athlete Media Consent

I acknowledge, consent, and intend that my acceptance of the foregoing agreements, policies, and waivers is the same as my electronic signature, which serves as the legal equivalent of my manual/handwritten signature. I further agree my acceptance of these documents is as valid as if I signed the document in writing.

I hereby affirm that my acceptance of the foregoing agreements, waivers, and policies were signed by myself with full knowledge and consent and am legally bound to these terms and conditions.
